Позиция по Шведският случай

Mr. President,

I am writing this letter on behalf of the Association of Home Education in Bulgaria, which is a non-profit organization for the protection of the rights of families, among which is the right of parents to direct the education of their children. We would like to express our deep concern about the case of the Swedish family of Christer and Annie Johansson, whose 9-year-old son Dominic Johansson has been in state custody and separated from his parents for over 18 months. On 25th June 2009 this family was about to board an airplane for India, which is the country of Dominic’s mother, when their son was taken from them, and until now he is still in state custody. No other reason has been stated by the Swedish authorities except that Dominic was homeschooled.

With growing alarm we have followed Johanssons’ case as it went through every level of the Swedish court system only to see that this family has been denied the right to make decisions regarding their son’s education, the right to leave their country, and the right to select their own legal counsel. Now the ECHR is the family’s only remaining recourse to seek justice.

In June 2010, HSLDA and the Alliance Defense Fund (ADF) filed a joint application at the European Court of Human Rights (ECHR) on behalf of the Johansson family. From various media reports we became aware that their application has still not been assigned a case number, neither was there any response by the Court to their request for emergency measures.

The Association of the Bulgarian homeschooling families would like to express their solidarity with the Johansson family. We would like also to plead the Court to show greater expediency in dealing with Johanssons’ request for emergency measures and assigning of a case number. Many families in Bulgaria follow with growing concern the development of this legal case and are apprehensive about the ramifications, which any such delay in the administering of justice may have on the integrity of the families.
